IP protection and regulatory clearance are often top priorities for life science companies, while concerns of protecting the company from the unpredictable future risk of products liability exposure are not often as paramount. However, as the number of lawsuits filed against life science companies increase each year, and the verdicts awarded grow, it is equally important that companies are aware of the threat of products liability exposure and take steps during the development and post market surveillance phases to best protect their assets and mitigate against that threat.

In this presentation, Sean Burke, Vice Chair of the Products Liability Trial Department at Duane Morris, will provide an overview of the current litigation landscape facing life sciences companies. He will overview the types of claims and legal theories advanced by plaintiff attorneys, explain how certain practices and steps taken by life sciences companies may be used against them at trial, and discuss ways in which companies can protect and defend themselves against this threat.
